These terms are the agreement between you and Eyescout Sports for use of eyescoutsports.com and the EyeScout Sports mobile apps. By creating an account or using the service, you accept them. If you do not agree, do not use the service.
You are responsible for your account credentials and for everything done through your account.
You keep ownership of the photos, videos, and text you post. By posting, you grant Eyescout Sports a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute that content for the purpose of operating and promoting the service, including showing it to coaches and other users. This licence ends when you delete the content, except for copies already made by others through a share link and for reasonable backup retention.
You confirm that you own or have permission to post what you upload, and that it does not infringe anyone else's rights.
You agree not to:
Captions are screened before a post is published, and slurs, sexual content, and threats are blocked from posting. Every post, story, profile, and message thread can be reported from its "..." menu, and any user can be blocked from the same menu — blocking hides all content and messages between the two of you, in both directions. Reports are reviewed within 24 hours and we remove content that breaks these rules.
We may remove content, suspend, or terminate an account — with or without notice — for any violation. Objectionable content is removed and the responsible user ejected. If your post is removed you will be notified in the app.
EyeScout Sports is free. Creating an account gives you the full platform — your profile, the feed, stories, posting, search and messaging — at no cost. There is nothing to buy in the app, no subscription, and no paid tier. If you ever see a charge you don't recognise, email info@eyescoutsports.com and we will sort it out.
Photography and videography are real-world services, booked by arrangement and invoiced separately. Nothing is sold or paid for inside the app.
Bookings are confirmed once scheduled by us. Eyescout Sports retains copyright in photographs and video we produce; you receive a licence to use delivered images for personal and recruiting purposes. We may also use images we produce to promote Eyescout Sports. If you do not want images of your athlete used promotionally, tell us in writing and we will honour it.
You are responsible for your own compliance with any eligibility rules that apply to you, including NCAA, NAIA, NJCAA, state association, and school rules regarding recruiting, publicity, and name/image/likeness. Check with your compliance office before acting.
You may delete your account at any time: Settings → Delete Account. This permanently removes your profile, posts, photos, and messages. It cannot be undone.
We may change, suspend, or discontinue any part of the service. We aim for reliability but do not guarantee uninterrupted or error-free operation.
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that content posted by users is accurate, and we are not responsible for the conduct of any user, athlete, or coach — online or offline.
To the maximum extent permitted by law, Eyescout Sports is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunities. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or 100 US dollars.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify Eyescout Sports against claims arising from your content or your use of the service in breach of these terms.
If you believe content on EyeScout infringes your copyright, email info@eyescoutsports.com with the work concerned, the location of the content, your contact details, and a statement that you have a good-faith belief the use is unauthorised. We remove infringing content and repeat infringers lose their accounts.
Where you obtained the app from Apple: these terms are between you and Eyescout Sports only, not Apple. Apple has no obligation to provide support for the app. Apple is not responsible for any product warranties or for addressing any claim relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
We may update these terms. Material changes will be notified in the app or by email, and the date above will change. Continuing to use the service after a change means you accept it.
These terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Arizona.
